Justice Faiz Isa’s petition should be declared inadmissible: Government’s position in the Supreme Court

In the case of Justice Qazi Faiz Issa review, the federal government has taken a stand in the Supreme Court that the petition of Justice Faiz Issa should be declared inadmissible.

A 10-member larger bench headed by Justice Umar Ata Bandial heard the review petitions in the case of Justice Qazi Faiz Issa in the Supreme Court.

Additional Attorney General Amir Rehman, while giving arguments regarding live broadcast of the hearing, said that the request of Justice Qazi Faiz Issa should be declared inadmissible as the request for live broadcast of the case was not admissible.

He said that no other application could be filed during the review petitions, Article 184/3 could not be filed in the review case, the law mentions open court hearing, not broadcasting on media.

During the hearing, Justice Qazi Faiz Issa while giving arguments said that my life has been under the microscope for 2 years, now I want everyone to come out openly, I am ready to be ashamed in public but the government is scared.

He further said that the government has destroyed the media, they want propagandists and controlled media to speak on their behalf, they are propagandizing against me by tearing their throats, people are going to YouTube, they are also on it. There is an objection.

Justice Qazi Faiz Issa said that Shehzad Akbar killed me by holding a press conference in May 2019. Two years have passed and now Shehzad Akbar is so scared that he does not come to court.

The Additional Attorney General in his arguments said that live broadcast is the right of the media and not of any party, no media house has applied for live broadcast in the court.

Justice Umar Ata Bandial remarked that Justice Qazi Faiz Issa says there are restrictions on media, Justice Faiz Issa is dependent on the decisions of foreign courts.

Justice Mansoor Ali Shah said that with the help of technology, the court has been facilitated in many cases. Hearing on video link is also due to technology. The federal government should not tell us what to do. Live broadcasting is the prerogative of the court. Not the government.

The Additional Attorney General said that the government was of the view that this was not a judicial matter but an administrative matter of the Supreme Court, to which Justice Muneeb Akhtar said that the hearing was still being held in open court.

Amir Rehman said that there is a difference between live broadcast of judicial and parliamentary proceedings, debate in parliament is general and technical in court, the language used in judicial proceedings is not common sense.

Justice Mansoor Ali Shah remarked that we are living in a global village, we have to walk with the world, nothing is secret in the court proceedings, the Supreme Court is the court of the people of this country, if a person sitting in Gwadar wants to watch the court proceedings How can you stop?

“There is no point in sitting on the ground like an ostrich. If a lawyer or a judge insults someone, the public should know. There is no debate in the court that is not worth listening to,” he added. We need to know what we are doing.

Additional Attorney General Amir Rehman said that the hearing has been held on camera many times. Brazil even said that the conversation of the judges’ chambers will also be broadcast.

Justice Muneeb Akhtar said that there are 10 judges in the court at present, 6 other judges are not present, how can they order live broadcast without listening to the remaining esteemed judges? If 10 judges give an order, all other judges will abide by it.

The Additional Attorney General said that to see justice done means that the decision should be impartial, to which Justice Muneeb Akhtar said that hearings in open courts are also held to see justice being done.

The Supreme Court adjourned the hearing of Justice Faiz Issa’s case till March 17.
